How to File a Complaint Against an Attorney in Kentucky

by M. Wade
  • Overview

All attorneys licensed in the state of Kentucky must follow the Supreme Court's rules of professional responsibility. If you believe that a Kentucky attorney has committed unethical conduct, such as using fraudulent billing practices or engaging in inappropriate relationships with clients, you should file a complaint with the Kentucky Bar Association. You should keep in mind that the Kentucky Bar Association cannot adequately police its attorneys unless concerned people like you take the necessary steps to bring allegations of unethical conduct to its attention.

  • Step 1

Call the Kentucky Bar Association to speak about your situation and inform them of a complaint. While they cannot accept a complaint by telephone, it is a good idea to talk to someone about the problem as you prepare to file your complaint. The phone number is 1-502-564-3795, extension 239.
  • Step 2

Gather supporting materials. Make copies of all documents that are relevant to your complaint, such as invoices, letters, emails, and recorded correspondence. Any documents or recordings you send with your complaint will not be returned to you. It is important to retain the originals.
  • Step 3

Familiarize yourself with the rules of the Supreme Court of Kentucky. It governs attorneys licensed in the state, and you must be sure to review the rules and procedures to ensure that the review of your complaint will not be delayed and to be sure that you understand the process of attorney investigations. You can request a copy of these rules from the Kentucky Bar Association. Please see our Resources section for the link to its Website.
  • Step 4

Draft your complaint. Your complaint must be handwritten in black ink or typed. It must specifically describe the unethical conduct that you allege an attorney has committed. You must also provide the names and contact information for any witnesses you have to the alleged unethical conduct. Keep it simple and to the point. The state's government needs efficiency and professionalism to proceed as quickly as possible.
  • Step 5

Get a notary. In Kentucky, you must sign your complaint and have your signature notarized on the complaint. If you fail to provide a notarized signature to the Kentucky Bar Association, your complaint will be delayed.
  • Step 6

Mail your documents to the Kentucky Bar Association. Send all of your documents by mail to the Kentucky Bar Association's Office of Bar Counsel in Frankfort, Kentucky. This is the only way you can send your complaint to the association. It does not accept complaints by any other method. The exact mailing address is: 514 W. Main Street, Frankfort, Kentucky, 40601-1812.
